The case between SM Entertainment and JYJ regarding the group′s contracts as TVXQ (DBSK) was again pushed back without any conclusion.

On September 18, the civil court of the Seoul Central District Court attempted to mediate between the two parties. The final decision on the case was originally to be made on September 13, but it was postponed and the case was sent back to the mediation stage under the authority of the justice department.

The justice department brought in Head CEO Kim Young Min of SM Entertainment and lawyers from both sides to try to reach an agreement, but failed. Another attempt was offered, but no deadline was set in order to have the two parties talk the issue over with ample time. The final decision on the case was thus postponed indefinitely.

The fight between JYJ and SM started in 2009 when the group filed an injunction on the cancellation of their unjust contracts. The court had accepted that injunction, leading SM Entertainment to file in April 2010 for a confirmation that the contract still stood and for a compensation for damages. JYJ answered with a demand for confirmation that the contract was non-existent.

In February 2011, the court dismissed the complaints SM Entertainment filed against JYJ′s injunction. With this decision, the court confirmed that "the contract between the two parties is void, and the court guarantees JYJ′s independent promotions."
